US Judge Orders Freedom of Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to face human smuggling allegations, he was detained in immigration custody.
In her decision, the court noted that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."
